Why would you expect someone to be right going forward when they were always wrong going back?

The International Association of Color Manufacturers filed the lawsuit, arguing the ban causes economic harm, oversteps state authority on food safety, and disrupts interstate commerce.

Berger ruled that the law’s definition of β€œpoisonous and injurious” lacks clear criteria, potentially leading to arbitrary enforcement, though she rejected claims it constituted an unlawful bill of attainder.

West Virginia Governor Patrick Morrisey expressed disagreement with the decision, stating the state will explore legal options to protect public health, particularly for children.

Kennedy, who visited West Virginia in March to support the ban, has linked such additives to health issues like ADHD and cancer based on studies. Delegate David Elliott Pritt criticized food companies for prioritizing profits over safety.

John Shoreman was already representing Cole Jr., and now Mario Williams, the president of Humanity Dignity and Rights LLC, has joined the defense.

Neither of those attorneys is a criminal defense attorney, but Joseph Alexander Little IV is.

Prior to private practice, he was a clerk at the International Criminal Court in The Hague and from 2007 to 2013 was Assistant U.S. Attorney for the Middle District of Tennessee.

After being pardoned by President Trump, Tina Peters filed a motion asserting that the State of Colorado has lost jurisdiction in her case.

The Colorado Court of Appeals has ordered the state to respond to the motion by January 5th.
A reply by Peters is due by the 8th.

Oral arguments are set for January 14th.

ICYMI: Today, FBI Director Kash Patel announced that the bureau has finalized plans to permanently close its J. Edgar Hoover headquarters and relocate to the Ronald Reagan Building in downtown Washington, D.C.

The FBI and General Services Administration selected the Reagan Building in July, following Republican concerns over the expense of a proposed move to Maryland.

Patel said the shift will save taxpayers at least $5 billion by using an existing facility instead of building a new one projected to cost nearly $5 billion and open in 2035.

No specific timeline was provided for the closure and transition, but safety and infrastructure upgrades are already in progress.

The Reagan Building previously housed the U.S. Agency for International Development, which was consolidated into the State Department earlier this year, allowing U.S. Customs and Border Protection to occupy part of it.
