RTX is the third largest defense contractor in the world and the second largest in the United States. They have three main operating divisions:

The 750 violations span August 5, 2017, to September 29, 2023. Though all RTX affiliates committed "a substantial number of violations", the majority, including some of the most egregious, were committed by Collins prior to their 2018 acquisition by RTX, but also after.

In 3 separate voluntary disclosures to the State Department from 2021-2023, it was revealed that technical data related to the E-3 Sentry, KC-390 and F-22 Raptor had been exported to the PRC. This was caused by Collins misclassifying the data as non-ITAR controlled.

In another disclosure, it was revealed that from 2015-2023, Collins exported technical data for printed wiring boards to the PRC. Collins then procured the boards from subcontracted Chinese entities and delivered them to other firms for end use in military aircraft.

Between 2013 & 2027 Collins also exported technical data related to the environmental control system of the F/A-18 E/F Super Hornet. The US Government found that this unauthorized disclosure harmed US national security.

Moving onto Raytheon, between 2017 & 2022, they exported without authorization defense articles to numerous US allies. Of particular concern are exports to Saudi Arabia, Turkiye & the UAE, who have historically been restricted from procuring certain sensitive technologies.

Unauthorized exports to US allies (Australia, Germany, Norway & the UAE) even included classified defense articles/data related to several missile programs, such as NASAMS, ESSM, TLAM & AMRAAM-ER.

This is a widespread problem throughout RTX, with all affiliates engaging in violations related to a wide variety of highly sensitive programs. Defense articles were exported, reexported or transferred without authorization to 25 different countries, including the PRC.

Though these aforementioned cases have been caused by a culture of negligence, there are cases of individual employees engaging in potentially malicious activity as well. One brought their work laptop, containing ITAR controlled data, with them on a personal trip to Iran.

Another made multiple trips to Russia to visit his fiancée, also bringing his work-issued laptop, which contained a wide variety of ITAR controlled technical data related to several US military aircraft.

In the most egregious case, another employee made multiple trips to Lebanon, again with their work laptop, and purposefully obfuscated that they had travelled there. An investigation found that these incidents disclosed technical data and harmed US national security.

In determining the charges & penalties to pursue, the State Department considered both the mitigating and aggravating factors. RTX's voluntary disclosure of the violations & cooperation with the investigation were key in reducing the number of charges & the monetary fine.

Half of the $200 million penalty is being suspended, conditional on those funds being applied to the Consent Agreement-authorized remedial compliance costs. The other $100 million is payable through three instalments.

Three obvious candidates are the employees who travelled to Iran, Russia and Lebanon. Those were just isolated incidents among a sea of violations stemming from institutional failures though. Ultimately, senior leadership should be held accountable.

They seem to be failing upwards though. Kelly Ortberg, the CEO of Collins from 2013-2021, was just hired as CEO of Boeing last month. The man who oversaw the majority of the ITAR violations, now leads the troubled Boeing, which had its own violation back in January.

The State Department's Consent Agreement with RTX does not preclude further enforcement action by either State or the Department of Justice though. Criminal charges could still be brought against individuals involved, although it is uncertain whether that will happen.

🇺🇸🇩🇰🇺🇦 Danish PM Frederiksen: "I was ready to deliver [F-16s] from the beginning of the war but once again we had quite long discussions about was it a good idea or not." "We are not putting restrictions on F-16s."

Unfortunately, the Biden Admin is still not agreeable to this.
