☝️Статус токенов в США до сих пор не определен и это вызывает массу вопросов. Большинство инвесторов считали, что если проект, выходящий на ICO, предлагает им токены по принципу SAFT (Simple Agreements for Future Tokens), то это не должно вызывать проблем с регуляторами. Но последние считают, что это не так.
✔️На сайте агентства по регулированию деятельности финансовых институтов появилось сообщение – использование принципов SAFT не может быть гарантией одобрения властями и не обеспечивает 100% безопасности тем, кто вкладывается.
☝️Напомним – суть принципов SAFT в том, что в начале процесса монеты продаются как ценные бумаги, но потом, когда проект развивается, токены могут изменить свою природу.
В заявлении FINRA сказано, что несмотря на одобрение SAFT, как концепции в целом отвечающей законам США, нет гарантии, что суть происходящих в проекте процессов будет продолжать соответствовать законодательству. И что в будущем SEC или американский суд будут считать так же. Поэтому безопасность инвесторов может гарантировать только сам проект, но не название концепции.

Representatives of the US agency FINRA reported that ICO investments in projects using SAFT do not mean that the regulator has no questions.
☝️Status of tokens in the United States has not yet been determined and this raises a lot of questions. Most investors believed that if a project going to the ICO offered them a SAFT (Simple Agreements for Future Tokens) token, then this should not cause problems with the regulators. But the latter think that this is not so.
✔️A website of the agency regulating the activities of financial institutions has a message - the use of SAFT principles can not be a guarantee of approval by the authorities and does not provide 100% security to those who invest.
☝️Remember - the essence of SAFT principles is that at the beginning of the process coins are sold as securities, but then, when the project develops, tokens can change their nature.
The FINRA statement said that despite SAFT's approval as a concept generally in accordance with US laws, there is no guarantee that the essence of the processes occurring in the project will continue to comply with the law. And that in the future the SEC or the American court will consider the same. Therefore, only the project itself can guarantee the safety of investors, but not the concept name.
