Налоговая служба РФ получила информацию о более чем 100 000 пользователей P2P-платформы LocalBitcoins за 2021 год. Об этом сообщил управляющий партнер GMT Legal Андрей Тугарин со ссылкой на данные ведомства.
✅LocalBitcoins зарегистрирована в Финляндии и на постоянной основе взаимодействует с финской полицией и налоговой службой. Напрямую информация о клиентах платформы в государственные органы и службы РФ не предоставляется.
🔺Тугарин рассказал, что LocalBitcoins передает данные в налоговую Финляндии, а та, в свою очередь, предоставляет их по запросу ФНС РФ в рамках Конвенции о взаимной административной помощи по налоговым делам. Именно такая процедура придает переданной информации официальный статус.
Запрос касался информации за 2021 год, поскольку это текущий отчетный период для налоговой.
🔺«Сегодня в РФ разрабатывается огромное количество законов, связанных с цифровыми активами. Все государственные органы сконцентрированы на получении максимального количества данных о держателях криптовалюты на территории страны», – отметил Андрей Тугарин.
☝️Во избежание проблем юрист рекомендовал российским пользователям LocalBitcoins заняться составлением налоговой декларации. Отчетный период заканчивается 4 мая.
17 февраля 2021 года Госдума РФ в первом чтении приняла за основу законопроект о налогообложении операций с криптовалютами. Ожидается, что окончательно его примут до конца весенней сессии.
📌Документ признает криптовалюты имуществом и обязывает отчитываться перед налоговыми органами об обороте цифровых активов на сумму свыше 600 000 рублей в год.
В случае неуплаты или неполной уплаты налога от операций с цифровыми валютами штраф составит 40% от суммы неуплаченного налога.
📌В 2021 году крупнейшая американская криптовалютная биржа Coinbase получила пять запросов на раскрытие информации о пользователях от государственных и правоохранительных органов РФ.

The Tax Service of the Russian Federation received information about more than 100,000 users of the LocalBitcoins P2P platform in 2021. This was announced by the managing partner of GMT Legal Andrey Tugarin with reference to these departments.
✅LocalBitcoins is registered in Finland and interacts with the Finnish police and tax authorities on an ongoing basis. Direct information about the clients of the platform is not provided to the state bodies and services of the Russian Federation.
🔺Tugarin said that LocalBitcoins transfers data to tax authorities in Finland, which, in turn, provides them at the request of the Federal Tax Service of the Russian Federation under the Convention on Mutual Administrative Assistance in Tax Matters. It is this procedure that gives the transmitted information official status.
The request concerned information for 2021, since this is the current reporting period for the tax.
🔺“Today, a huge number of laws related to digital assets are being developed in the Russian Federation. All government agencies are focused on obtaining the maximum amount of data on cryptocurrency holders in the country,” said Andrey Tugarin.
☝️In order to avoid problems, the lawyer recommended that Russian users of LocalBitcoins start preparing a tax return. The reporting period ends on May 4th.
On February 17, 2021, the State Duma of the Russian Federation in the first reading adopted as a basis the bill on taxation of transactions with cryptocurrencies. It is expected that it will be finally adopted before the end of the spring session.
📌The document recognizes cryptocurrencies as property and obliges to report to the tax authorities on the turnover of digital assets in the amount of more than 600,000 rubles per year.
