The standard therefore boils down to what Oregon decides is what is and what isn't excessive.
Now consider that against the fact that their state law considers using tear gas on protesters being excessive.

The fact is that this isn't a good-faith attempt aimed at curbing brutality so much as it's a calculated escalation. The idea, and almost certainly the intention, would be to render federal police work in Oregon virtually impossible from an operational perspective.

NEW: The Trump administration has said that it will withhold SNAP food aid from Democrat-controlled blue states unless they provide recipient records, per the Associated Press
A lawsuit brought by 22 Democratic-controlled states is currently working its way through the courts, in which they argue against being required to allow the federal government to audit their SNAP/EBT operations.
This is absurd.
Any state that voluntarily accepts federal tax dollars for state-administered operations can't then refuse to submit to a federal audit of said operation(s). That assertion is both civilly repugnant and unlawful to boot.
They will lose the case, and the federal government will eventually perform the audit. That said, it's all but a certainty that the amount of criminality uncovered will be shocking.
In the interim, the Trump Admin, certain in its impending victory, is tightening the screws by simply withholding $$ to fund SNAP from these states until they comply.
Sure, they'll argue that he's going to starve babies and the like, but it would be a bald-faced lie. All they have to do is what they'll have to do anyway (share the information), and the program would be funded. Yet, they're all but a lock to resist, therefore keeping benefits from reaching their state's residents, and all to hide their criminal collusion in the rampant fraud and abuse going on.
The only logical reason that they're fighting tooth & nail against doing so is essentially confirmation of how bad it's going to be for them.
Trump has them caught square in the middle of a Catch-22... which is apropos, given it's 22 states holding out.

There are two vacancies (retirement and death - both Democrats) that I am leaving out (435 being the total count), as the resolution of said seats is still unclear.
So, if the current trend continues, the GOP could add +14 seats in the November 2026 election, making the split 234-199.
Texas +5, Florida +5, Missouri +1, North Carolina +1, Indiana +2
Among other advantages, this means the GOP can lose up to 17 Republican votes on any bill and still pass it on party lines (since 218 votes are needed).
This is significant as the GOP's current margin of error is only seven votes, which is difficult to navigate given the handful of RINOs who have a history of siding with Democrats. Their influence would be negated.
On-deck efforts currently being considered by additional states could push the GOP advantage into the +17-20 range.
NOTE: There's not enough time to do so in the traditional fashion, but since it can be argued that the Census was unlawfully conducted via the Huntington-Hill method, a mathematical recount of the U.S. population to exclude illegal aliens and recalculate congressional apportionment isn't out of the question.
