OAN Reviews Impotent Letter From DOJ Trying To Stop Ariz. Audit

The United States Constitution grants the power to oversee elections exclusively to state legislatures, meaning the federal government has no authority to interfere in the audit. The letter was fairly benign and only cited media reports as evidence.

The main issues raised were with regard to voting rights, especially for minority voters, and the security of the facility, both of which have been easily addressed by the Senate. In fact, the letter did not include a single piece of factual evidence on which the DOJ could base their concerns.

Bennett responds to the two concerns in the DOJ letter:

1. On lack of ballot security, "That is completely unfounded." There has been 24/7 security and video surveillance, the building is secure.

"Nobody is in the building that shouldn't be in the building."

2. On potential voter intimidation, he said "If I have anything to do with it, there won't be any voter intimidation."

I asked if he would have something to do with it. "I hope so." Not going door to door, but he find out what plan is. "I haven't seen that part of the audit."

Cyber Ninjas Statement: Settlement Changes Nothing

Arizona Senate Republicans' lead auditor, Cyber Ninjas, responds to settlement of lawsuit filed by AZ Democratic Party: "Settlement changes nothing .. It is a tool being used by enemies of transparent democracy to pursue a narrative undermining the most comprehensive election audit in American history."

Cyber Ninjas goes onto say that signature verification was “never in the scope of the audit in the first place, and would not have been done. “

Senate President Karen Fann diplomatically manages Arizona Horizon’s Blue Anon Ted Simmons

Fann describes being threatened daily with lawsuits and four letter words. “They do not want this audit,” Fann says. “They talk about conspiracy theories… well, there is almost a reverse conspiracy theory now to demean this audit.”

Responding to the Dem’s crutch claim that the Board of Supervisors already conducted audits and found no irregularities, Fann explains that the Maricopa BOS only looked at 2%! of the ballots. Furthermore, they did not choose forensic auditors, they chose 2 firms (Pro V&V and SLI) that are only authorized to certify machines — and Pro V&V certified the machines to begin with.

The people have a right to feel confident in their elections. “If we don’t do it, who will?” Fann asked Simmons.

“With all due respect, [your letter] reads like a political press release calculated to undermine a process that you have opposed since its inception. You will surely recall that when the audit was in the planning stages, the Senates representatives extended invitations to you and your fellow Democrats to collaborate in the formulation of audit procedures, which you rebuffed. My first act as the Senate Liaison was to reach out to the AZ Democratic Party to ask for a Democrat Co-Liaison to work beside me throughout the audit, which was rejected 3 times. … Needless to say, these rejections detract from the credibility of your professed interest in the conduct of the audit.

“Your decision to wait to send your letter until right after signing your settlement agreement demonstrates a degree of bad faith. You clearly had these concerns before signing the settlement agreement, and you could have raised them with us or incorporated them into the agreement before releasing your claims. Pursuant to Sections 2 and 3 of the Settlement Agreement, inter alia, you agreed to release all claims advanced in the litigation, including your claims that the auditor’s policies are legally inadequate or not “consistent with state and federal statutory and constitutional law and the EPM, including with respect to the security and integrity of ballots and election equipment.” (See Motion to Intervene filed on April 28th, 2021, page 8, inter alia.) Therefore, to the extent that you still question the adequacy of the auditor’s policies, you have released those claims; and to the extent that your letter implies that you intend to take any further legal action on that basis, you are in breach of the Settlement Agreement.

"As to your other concerns of risk, confusion, errors, and disregard of best practices, I suggest that these are opinions of your observers, with which I respectfully disagree. You have personally referred to this audit as a “Fraudit”, which confirms a bias and, therefore, lack of credibility far beyond the lack of credibility you assert. transmitted through the observers you send. Still, we welcome them and their input on how to make the audit successful."

Senate President Karen Fann Responds to the DOJ

Senator Fann tells the Department of Justice that the audit team has "indefinitely deferred" plans to canvass neighborhoods and knock on people's doors to verify voter registration information, a plan that Blue Anon critics and the OBiden DOJ worried would amount to voter intimidation.

Auditors made the decision weeks ago, before the partisan DOJ letter citing unfounded concerns about voter intimidation. The audit’s canvassing needs will be evaluated as the audit nears completion.

Propaganda Press AZ Mirror: Fann tells DOJ she has scrapped deferred audit plans to canvass voters.

Wishful Blue Anon thinking? Nothing in Fann’s statement suggests the canvassing operation has been abandoned. Last time we checked, “deferred” wasn’t a synonym for “scrapped.”

The statement of work for Cyber Ninjas, the Florida-based cybersecurity firm that is overseeing the audit, states that the audit team worked with unnamed individuals to “statistically identify voter registrations that did not make sense.” The plan called for auditors to visit voters’ homes to determine if the person listed in voter registration records lived there and if they voted in the election.

Fann said the audit team won’t choose voters or precincts based on race, ethnicity, sex, party affiliation or any other legally protected status. Audit workers won’t carry firearms or wear badges or other insignia that would falsely imply they’re law enforcement or other government agents. Instead, they’ll wear brightly colored shirts identifying the specific vendor they’re working for. And they’ll explain up front that the voters don’t have to answer questions and that they’re not under investigation, using a standardized script with pre-approved questions.

“If canvassing is necessary to complete the audit, we believe these protocols, which will be reinforced by thorough training programs, would permit the Senate to discharge its legislative oversight and investigation functions without compromising the rights or privacy of any voter,” Fann said in the letter.

In response to the Justice Department and Brennan Center letters, former Secretary of State Ken Bennett, who is serving as a spokesman and liaison for the audit, described the canvassing in terms that implied it was still part of the audit team’s plans. He described the request for federal monitors as “laughable” and defended the plan from allegations of voter intimidation.
