Asked what he wasn't able to do to evaluate the voting machines because they are missing certain passwords, he said they would not be able to gain administrative access that they believe that would allow them to run batch reports on ballots.
On batch reports...
Batch reports a way that the auditors could break down the ballots by groups as they count, to compare to the county's count.
Without them, they can only compare the final totals.

The United States Constitution grants the power to oversee elections exclusively to state legislatures, meaning the federal government has no authority to interfere in the audit. The letter was fairly benign and only cited media reports as evidence.
The main issues raised were with regard to voting rights, especially for minority voters, and the security of the facility, both of which have been easily addressed by the Senate. In fact, the letter did not include a single piece of factual evidence on which the DOJ could base their concerns.

Fann describes being threatened daily with lawsuits and four letter words. “They do not want this audit,” Fann says. “They talk about conspiracy theories… well, there is almost a reverse conspiracy theory now to demean this audit.”
Responding to the Dem’s crutch claim that the Board of Supervisors already conducted audits and found no irregularities, Fann explains that the Maricopa BOS only looked at 2%! of the ballots. Furthermore, they did not choose forensic auditors, they chose 2 firms (Pro V&V and SLI) that are only authorized to certify machines — and Pro V&V certified the machines to begin with.
The people have a right to feel confident in their elections. “If we don’t do it, who will?” Fann asked Simmons.

You will surely recall that when the audit was in the planning stages, the Senates representatives extended invitations to you and your fellow Democrats to collaborate in the formulation of audit procedures, which you rebuffed. My first act as the Senate Liaison was to reach out to the AZ Democratic Party to ask for a Democrat Co-Liaison to work beside me throughout the audit, which was rejected 3 times. … Needless to say, these rejections detract from the credibility of your professed interest in the conduct of the audit.
“Your decision to wait to send your letter until right after signing your settlement agreement demonstrates a degree of bad faith. You clearly had these concerns before signing the settlement agreement, and you could have raised them with us or incorporated them into the agreement before releasing your claims. Pursuant to Sections 2 and 3 of the Settlement Agreement, inter alia, you agreed to release all claims advanced in the litigation, including your claims that the auditor’s policies are legally inadequate or not “consistent with state and federal statutory and constitutional law and the EPM, including with respect to the security and integrity of ballots and election equipment.” (See Motion to Intervene filed on April 28th, 2021, page 8, inter alia.) Therefore, to the extent that you still question the adequacy of the auditor’s policies, you have released those claims; and to the extent that your letter implies that you intend to take any further legal action on that basis, you are in breach of the Settlement Agreement.
